Sure! Here\u2019s one that played out in February, 2023.<\/p>\n\n\n\n<p>First up, an exchange with someone from the youtube channel Murder Murder News.<\/p>\n\n\n\n<p>Hello \u2014<\/p>\n\n\n\n<p>Earlier today I was doing a reverse image search for some of my Jane Britton portraits, and I noticed that you\u2019re using three of them in your youtube video, without attribution. All these images have appeared in print publications, always with attribution, as per my licensing agreements with the publications.&nbsp;<\/p>\n\n\n\n<p>\/ link to a video that has been taken down \/<\/p>\n\n\n\n<p>This is not OK.<\/p>\n\n\n\n<p>I\u2019d like you to re-edit the video and whenever my images are used there should be text along the lines of \u201cPhotograph by Don Mitchell.\u201d&nbsp;<\/p>\n\n\n\n<p>Don<\/p>\n\n\n\n<p>A short time later, this unsigned email arrived:<\/p>\n\n\n\n<p>A few things regarding copyright law. Firstly, my background is as a CEO of a software company, so I know quite a bit about copyright law from working closely with attorneys. I\u2019m happy to engage one of those attorneys just for fun! I can\u2019t imagine you own the rights to Jane\u2019s photos, but I will look into it because I\u2019m curious as to who the original photographer may have been. Do you have permission to use them if they aren\u2019t public domain? The rights would have died with them, and the photo is commonly used on monetized sites without accreditation. Aside from that, we have a non monetized YouTube channel and are not telling Jane\u2019s story for profit, so copyright laws don\u2019t apply to non-monetized social media. We honestly think monetizing from someone\u2019s story is pretty gross. The intent of our content is to change the conversation in making sure victims have a voice. I am looking into your crime writing now because this threatening email has rubbed me the wrong way and I would love to make sure our listeners have a heads up if your work is exploiting victims.&nbsp;<\/p>\n\n\n\n<p>A paragraph dense with bullshit. I replied:<\/p>\n\n\n\n<p>Careful reading is a big plus (whoever you are\u2026typically I expect people to identify themselves when writing emails \u2014 don\u2019t you?). I\u2019d have thought that as the CEO of a software company you\u2019d have learned that. Or maybe you have people reading your emails to you? &nbsp;<\/p>\n\n\n\n<p>\u201c\u2026as per my licensing agreements with the publications\u201d should have given you a hint that my inquiry was a serious one.<\/p>\n\n\n\n<p>I was the photographer. I have the negatives. I respond to requests for publication by licensing and billing entities who want to use my images. I am not suggesting that you pay me, only that you behave in an ethical manner.<\/p>\n\n\n\n<p>If you need more evidence, consider returning to where you grabbed the images. Probably this was the Boston Globe, most likely the Sunday edition with a story about Becky and her book. They paid me for the cover image (see the attachment) and for the inside image. Every image the Globe used was properly attributed to me, except for one in the November 2018 issue on the day of the press conference, which was wrongly attributed to the DA\u2019s office. I contacted the Globe, demonstrated that I had the original negative on my computer, and they changed the attribution immediately on the website.&nbsp;<\/p>\n\n\n\n<p>I\u2019m also guessing that you didn\u2019t take the trouble to figure out who I am. Didn\u2019t you listen to your own work? I was Jane\u2019s close friend. I\u2019m one of those who found the body. I\u2019m a central figure in Becky Cooper\u2019s book (as she is in mine).<\/p>\n\n\n\n<p>So by all means go ahead and \u201clook into it.\u201d<\/p>\n\n\n\n<p>Also, I have no idea at all where you get \u201crights would have died with them.\u201d The newspaper and publishers \u2014 sure. I licensed them for one-time uses. But me? My rights aren\u2019t going away for many years, and if you really do know copyright law you should know that.&nbsp;<\/p>\n\n\n\n<p>Contra your assertion, you do seem disinclined to actually do research (two or three minutes with Google before responding to my email would have shown you the attributions) so I\u2019m attaching a series of emails I exchanged with the Globe in 2020. Since you &#8220;know quite a bit about copyright law,&#8221; you can probably conclude that if a major newspaper was willing to pay me for a license, then I do own the rights.&nbsp;<\/p>\n\n\n\n<p>So, a summary:<\/p>\n\n\n\n<p>\u2014 my Jane pictures have appeared on (and in) every edition of Becky\u2019s book (US, UK, Netherlands), except for the cover of the UK paperback edition.&nbsp;<\/p>\n\n\n\n<p>\u2014 the Boston Globe, the Wall Street Journal, and a handful of UK newspapers have published my pictures, with full credit and with payment.<\/p>\n\n\n\n<p>Easy way out: edit your youtube video, add credit, done. That\u2019s all I\u2019m asking for. Was money mentioned? No, of course not. Was there a threat? Or course not.<\/p>\n\n\n\n<p>Where I come from, \u201cthreatening\u201d isn\u2019t a word that describes something as mild as \u201cI\u2019d like you to re-edit\u2026.\u201d But I guess eye of the beholder and all that.&nbsp;<\/p>\n\n\n\n<p>And\u2026seriously. Attorney threats are so very, very third grade. I laughed.&nbsp;<\/p>\n\n\n\n<p>I think I\u2019ll forward this exchange to Becky. It will amuse her.<\/p>\n\n\n\n<p>Don<\/p>\n\n\n\n<p>And in a few minutes,<\/p>\n\n\n\n<p>We removed the video from our channel. The story had very little interest anyway. Best.&nbsp;<\/p>\n\n\n\n<p>And that was the end of my interaction with the MurderMurder assholes, whoever they were. I never learned the person\u2019s name.<\/p>\n\n\n\n<p>I\u2019m still astonished that the person didn\u2019t even do a quick Google search. My emails have my full name, and a link to my book <em>Shibai: Remembering Jane Britton\u2019s Murder<\/em> which I would have thought an important clue that I wasn\u2019t some random would-be scammer or troll.<\/p>\n\n\n\n<p>So much for the asshole end of things.<\/p>\n\n\n\n<p>Now let\u2019s see what a serious, ethical, friendly response looks like \u2013 the \u201cGood Guy Youtuber,\u201d whose channel is called \u201cCrime Zone.\u201d<\/p>\n\n\n\n<p>Hello \u2014<\/p>\n\n\n\n<p>I was doing an internet search for my Jane Britton images and ran into your youtube video<\/p>\n\n\n\n<p>\/ link that\u2019s no longer active \/<\/p>\n\n\n\n<p>I see that you\u2019ve used five of my Jane images but have not attributed them to me. I attach the ones in question which you seem to have lifted from the Boston Globe article (that\u2019s my photograph on the cover of the Sunday magazine). I am the photographer and I hold the copyright; the Globe paid me to license those images. &nbsp;Consider a quick edit of your video to add my name to the images the first time they appear. We spoke back in February when you reached out about the&nbsp;images of yours we used in our Jane Britton video. The&nbsp;reason I&#8217;m writing again Don is because we&#8217;ve FINALLY (haha) gotten around to making another version of the video, and when I was going back through our last exchange&nbsp;I noticed that you mentioned that we had used five images but I only see four in the attachments. I want to make sure that we get the attribution completely right this time, so I was wondering if you wouldn&#8217;t mind letting us know which one that fifth&nbsp;image is so that we can make the necessary changes before re-uploading.&nbsp;<\/p>\n\n\n\n<p>Thank you!<\/p>\n\n\n\n<p>&#8212; Nigel&nbsp;<\/p>\n\n\n\n<p>I replied<\/p>\n\n\n\n<p>Hi Nigel \u2014<\/p>\n\n\n\n<p>You are one honorable man. Seriously.&nbsp;<\/p>\n\n\n\n<p>The fifth image is the one that was the cover of the Boston Globe magazine article. It\u2019s based on one of the \u201cstraight\u201d ones but with some editing to zero in on the eye (the Globe did that). It\u2019s at about 4:31 in.<\/p>\n\n\n\n<p>I\u2019ve been meaning to write something on my blog (I don\u2019t post there much) contrasting the way you responded to my email with the way the folks at murder murder murder did. They were just awful.&nbsp;<\/p>\n\n\n\n<p>I\u2019d better get to work. You deserve it.&nbsp;<\/p>\n\n\n\n<p>Don<\/p>\n\n\n\n<p>And Nigel\u2019s final email:<\/p>\n\n\n\n<p>Hey Don,<\/p>\n\n\n\n<p>Thanks for getting back to me so quickly! I will definitely go through and check for that final image. Also, haha you\u2019re too kind, but really it\u2019s us that should be thanking you! You were extremely nice about the whole thing considering it was OUR mistake, and we really appreciate the fact that you reached out to us directly. The last time something like this happened, let\u2019s just say the person had NO interest in talking to us.&nbsp;<\/p>\n\n\n\n<p>Anyway, I\u2019m glad we could get all of this sorted out finally. Just in case you\u2019re interested, I think we\u2019re planning to put the video back up the second full week of June, probably the 15th. Also, I\u2019ll be sure to check out the blog! I already went onto the photo blog you have in your email signature, and I really enjoyed the pictures there. If you go to the end, you\u2019ll find what was (to me) a big surprise.<\/p>\n\n\n\n<p>Well\u2026I don\u2019t think there\u2019s much more to say about this. The difference between the two responses is enormous.
